Terms of Service

These Terms of Service ("Terms") are an agreement between you and PopAPage ("PopAPage," "we," "us"), covering your use of the PopAPage app and this website. By creating an account or using PopAPage, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use PopAPage.

Who can use PopAPage

PopAPage is for parents and guardians. To use it, you must:

  • be at least 18 years old and able to enter a binding agreement;
  • be the parent or legal guardian of any child you add, or have that parent's or guardian's permission; and
  • not be barred from using the service under applicable law.

Children don't use PopAPage directly — you set them up as profiles and manage their information.

Your account

You're responsible for your account and for keeping your sign-in secure. You agree that the information you provide is accurate and that you have the right to enter any child's information you add. You're responsible for activity under your account, including caregivers you invite to your family.

A beta service

PopAPage is currently in beta and provided free of charge. It's a work in progress: features may change, be added, or be removed, and the service may occasionally be unavailable or contain bugs. We'll do our best to protect your data, but you shouldn't rely on PopAPage as your only record of anything important.

Your licence to use the app

We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use PopAPage for your family's own non-commercial use, subject to these Terms. You may not copy, resell, reverse-engineer, or build a competing product from the app.

Your content and data

You own the information you enter — your family's profiles, reading logs, and notes ("Your Content"). You grant us the permission we need to host, process, and display Your Content in order to operate PopAPage for you (for example, generating reading levels and recommendations). Our Privacy Policy explains how we handle it, and you can export or delete your data at any time.

Reading levels and recommendations are estimates

PopAPage's reading levels and book recommendations are automated, AI-generated estimates offered to help you choose books. They are not official assessments and are not educational, psychological, or other professional advice. Use your own judgement, and consult a teacher or specialist for any formal evaluation.

Acceptable use

When using PopAPage, you agree not to:

  • break the law or infringe anyone's rights;
  • attempt to access another family's data or any part of the service you're not authorized to use;
  • interfere with, disrupt, scrape, or reverse-engineer the service;
  • upload harmful code or otherwise misuse the service; or
  • use PopAPage to collect information about children other than your own.

Finding books and third-party links

PopAPage links to third parties — such as your local library, Bookshop.org, and Amazon — so you can borrow or buy books. Those sites have their own terms and privacy policies, and we're not responsible for them or for any purchase you make. Some links are affiliate links, and we may earn a small commission at no extra cost to you. When you use third-party services, you agree to comply with their terms.

Payments and subscriptions

PopAPage is free during the beta. If we introduce paid features later, we'll show the price and terms before you buy. Purchases made through the app are billed by the App Store, and any subscription renews automatically until cancelled; you can manage or cancel it in your App Store account settings, and refunds are handled by Apple under its policies.

Our intellectual property

PopAPage — including the app, website, name, logo, and the content we provide — belongs to us or our licensors and is protected by law. These Terms don't give you any rights in our intellectual property except the limited licence described above.

Apple App Store terms

For the iPhone app downloaded from Apple's App Store, you acknowledge that:

  • these Terms are between you and us only, not Apple, and we (not Apple) are solely responsible for PopAPage and its content;
  • Apple has no obligation to provide maintenance or support for the app;
  • if the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation for the app;
  • we, not Apple, are responsible for addressing any claims about the app — including product-liability, legal, regulatory, or consumer-protection claims, and any claim that the app infringes a third party's intellectual-property rights;
  • you must comply with applicable third-party terms when using the app, and you represent that you are not located in a U.S.-embargoed country or on a U.S. prohibited-parties list; and
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them.

Termination

You can stop using PopAPage and delete your account at any time. We may suspend or end your access if you violate these Terms or to protect the service or other users. If your access ends, the licence above ends too; the sections meant to survive — such as ownership, disclaimers, and limitation of liability — will continue to apply.

Disclaimers

PopAPage is provided "as is" and "as available," without warranties of any kind, to the fullest extent permitted by law. We don't promise that the service will be uninterrupted or error-free, or that reading-level estimates will be accurate.

Limitation of liability

To the fullest extent permitted by law, PopAPage and its team won't be liable for indirect, incidental, or consequential damages, or for loss of data, arising from your use of the service.

Indemnification

You agree to cover reasonable costs we incur from claims arising out of your misuse of PopAPage or your violation of these Terms or the law.

Governing law and disputes

These Terms are governed by the laws of the United States and the state in which we operate, without regard to conflict-of-laws rules. Before filing any formal claim, please contact us so we can try to resolve it informally first.

Changes to these terms

We may update these Terms as PopAPage grows. If we make material changes, we'll post the new version here, update the date above, and let you know. Continuing to use PopAPage after changes take effect means you accept them.
